Work In progress Cover

This refers to the period after a sale has been agreed but before any goods are despatched, where a business may manufacture a bespoke product specifically for one customer, i.e. bespoke machinery, branded goods

Often manufacturing bespoke goods can be a costly process – what happens if the buyer becomes insolvent before dispatch even takes place?

Trade protect can cover the costs incurred via Work in Progress cover, up to a maximum of 3 months. This will be charged at 5% of the total premium payable per month.

Discretionary Limit /Blind Cover

Discretionary Limit gives you the underwriting pen, allowing you to grant credit, (subject to a satisfactory status report or trading history) whilst being covered under your policy in the event of the buyer becoming insolvent. Standard limit applied is £10k.

Blind cover is for those instances where you are looking to branch out into new markets and find new customers. Blind Cover makes it easy to deal with a first order from a new entity offering 50% indemnity against an order value up to a maximum £5k, however once the client has traded past their first order ( paid to terms) then a Discretionary limit can be established, using trading experience to take the cover to 90% indemnity.

The manufacturing insurance market, and what to expect at renewal in 2021 and beyond

Cybersecurity Workshop Shows How Easy is it for Hackers to Access Data

Specialists in Risk Management for Manufacturers, Gallagher, gave some interesting yet freighting insight into how easy it is for hackers to access data this week. 20+ of Made in Group members joined the workshop, via video application Zoom, to see a demonstration of how hackers get in and a journey to the deep dark web.

Hosted by Johnty Morgan, Cyber Risk Specialist from Gallagher, the firm gave an insightful presentation on the potential risks manufacturers face regarding cybersecurity. Taking place on Wednesday 7th October 2020, one of the most interesting aspects of the presentation was how hackers access data. Most surprisingly, hackers don't even need to access the dark web to do this.

Since the beginning of the Covid-19 pandemic, many businesses were urged to allow staff to work from home. Six months into the pandemic there are still many businesses in this position, including office staff from manufacturing firms.

“Working from home poses massive threats to cybersecurity, due to less likely being protected by corporate software.” Explained Johnty, Cyber Risk Specialist.

He continued: “I would say 60-70% of the companies I deal with are manufacturers. This is due to how you guys make money. If hackers are able to shut down the shop floor, they know you would more likely be in distress and therefore likely to give your money away.”

To get this kind of access, many hackers use the dark web, which is easily accessible, once a particular browser or agent is downloaded. In the cybercrime world, this is an attractive proposition to criminals due to the high risk of not getting caught. One of the factors of this is the fact that the dark web will constantly change the users IP address, which is where they are located in the world. Johnty said:

“The dark web is as easy to get to as BBC news once the user downloads this particular browser for the dark web.”

However, most shockingly for members, there are a number of public domains out there that allow hackers to access IP addresses and all remote desktops if they have the right credentials to access a company's industrial control systems.

Many businesses now use a cloud-based system to store their data e.g iCloud or Google Drive. Hackers are able to use a deep web scanning tool to discover passwords for such data, including email addresses, in order to hold companies, Ransome. This act is called a credential stuffing attack.

Gallagher closed the presentation by offering their free consultation services exclusive to Made in Group members. The firm is able to conduct an open-source investigation on a company’s email addresses to see if there is any data about it on the internet. Johnty concluded:

“The biggest takeaway I would like you to take away from this presentation is that username and passwords are very vulnerable. You can strengthen these by including multi-factor authentication to your logins.”

If you would like a free consultation from Gallagher, contact the Birmingham office on 0800 062 2340.

Login to your microsite and head to “Virtual Events - Past Events” to find the video. Here’s a video on how to get there if you aren't sure.

Gallagher Business Assist- Major Fire Claim Case Study

This is how our additional service, Gallagher Business Assist (GBA) could help your business.

Our Client: A Food Manufacturer with Factories located in 4 separate geographical locations.

Our long-standing client suffered a serious fire at one of their production sites based in Essex. The factory concerned produced sausage products for the retail food sector. Their customer base included a major supermarket chain purchasing over £15m each year.

About 80% of the site was destroyed by an electrical fire. Our client’s immediate concern was that their inability to supply product to meet their customers needs would force those customers to seek alternative suppliers. Although the policy provided business Interruption cover for 24 months, our client was very concerned that some customers (particularly the major ones) may never return, potentially damaging their business on a permanent basis.

As the client had other production sites in the Midlands and in the East, it was hoped that they could simply shift production to one or both of those factories. However, there were several problems to overcome:

The production processes were completely different, the other sites were involved in bacon slicing and gammon production, not sausage.

The employees at the other locations didn’t possess the necessary skills.

The bespoke Machinery had all been destroyed in the fire.

Only one of the factories had any spare capacity to take on the work. It was located about 75 miles from the site where the fire occurred.

So, what was the solution? Working closely with our servicing team in Birmingham, our GBA colleagues negotiated with insurers for the machinery to be replaced at one of the alternative sites and insurers also agreed to pay the additional daily cost to transport the workers from the Fire damaged location to the other factory.

Our GBA team also obtained agreement from insurers to meet the significant costs of various sales promotions in order to ensure that the major customers remained loyal whilst all of the temporary logistical issues could be resolved.

Despite everyone’s best efforts, the business interruption and additional increased costs of working were mounting up rapidly on a monthly basis. We were able to secure Interim payments in order to provide much needed cashflow for our clients and to allow them to place the orders for the replacement machinery. Production was resumed but on a reduced basis and significant additional costs were incurred to make this possible.

After 14 months a final ‘cash’ settlement was agreed with insurers for a total sum of £19m (less interim payments). Insurers were persuaded that this would allow our clients to get on with their lives without the constant need to furnish more spreadsheets and explanations, whilst also allowing insurers to close their books on this major loss which could have rumbled on for another 12 months, potentially costing them significantly more.

Learning outcomes:

Nobody expects a major loss but it is imperative to be prepared for one.

Our clients expect us to be able to represent them to the same standard as insurers are represented by their Loss Adjusters. Gallagher Business Assist is our best way to ensure that we can meet that expectation.

The cost of GBA is of little consequence when measured against the benefits of having a fully trained professional loss adjuster working alongside you who is able to do all of the ‘heavy lifting’ on the claim.

Our clients know that we and our GBA colleagues work for the same company and that we have their interests as our mutual focus.

A happy client is a great endorsement to the Gallagher promise that we will stand by them when they need us most.

GBA have representatives all over the country, so no matter where the loss occurs we can quickly have someone on hand to deal with it under the Gallagher banner.

Insurance brokerage, risk management and consulting firm Gallagher have been appointed by Cradley Health-based metal casting firm Westley Group to support the business with its insurance and risk management requirements as the firm targets further growth across Europe.

Westley Group is one of Europe’s largest metal casting companies, specialising in the production and supply of copper-based and aluminium alloy metal parts.

Employing more than 280 people across its headquarters based on Doulton Road, plus manufacturing centres of excellence sites in Newcastle-under-Lyme, Staffordshire, and Cleckheaton, West Yorkshire, Westley Group serves clients in a range of sectors, including the marine, oil, power generation, process engineering and architectural industries.

With offices in Birmingham, Coventry and Brierley Hill, Gallagher is one the largest brokers in the West Midlands, employing over 400 risk and insurance specialists across the region.

Richard Grosvenor, sales director, Gallagher, said: “As a local community broker, providing an on-the-ground service to businesses in the region where we’re based, we’re proud to be working with a firm which has a longstanding presence in the West Midlands, and which has an excellent reputation in the metal casting industry.

“We are delighted to now be part of Westley Group’s growth journey, and look forward to supporting the business with its evolving risk management needs as it grows.”

Mike Richards, finance director, Westley Group, said: “Before engaging Gallagher’s support, we were aware that the insurance market was going through a period of ‘hardening’ – characterised by insurers charging higher premiums, and lower enforcing tighter terms and conditions– and we were concerned about significant cost increases when it came to our insurance renewal.

“From our very first meeting, the team at Gallagher impressed us with their sector knowledge, and the time they took to visit each of our sites in order to ensure they fully understood our business and how it operated. The team were able to negotiate us a deal that saw our cover increase, and premium reduce, providing us with the peace of mind we need to focus on growing our business.”

Industry-leading attendees also have the chance to network in smaller groups during the session.

Connectivity offers tremendous potential for manufacturers, however, it also poses some potential threats. Hosted by Gallagher’s Cyber Risk Consultant Johnty Mongan, in conjunction with the Made in Group, the event includes a live demonstration of the methods used by cybercriminals to exploit vulnerabilities, a summary of the current threat landscape and practical advice for manufacturing businesses to increase their technical protection and educate their workforces.

Manufacturing in the UK and Ireland has become the most attacked sector - representing almost a third of all cyber attacks1. Nearly half of manufacturers have been the victim of cyber-crime, and a quarter has suffered some financial loss or disruption to business as a result, according to a new report2. Cybercriminals have also adapted quickly to exploit further vulnerabilities bought about by COVID-19 such as remote working.

Join Gallagher and the Made in Group on 7th October at 14:30 - 16:00 to get involved. The event will entail:

A 360 Degree Review of Our Approach to Insurance

It has taken us several years of dedicated effort to turn our business into the success that it is today. It is a ‘statement of the obvious’ that we need to protect ourselves and our customers from any unforeseen event that could set us back from the position of strength that we have achieved. That is why we attach huge importance to our commercial insurance programme which sits at the heart of our defence mechanism. When I was approached by Richard Grosvenor (representing Gallagher), I decided that it was worth revisiting this important subject in order to check that we are fully protected.

Early in the process, Richard introduced us to a small team of his colleagues who carried out a full 360 degree review of our existing policies and it quickly became apparent that Gallagher were able to offer us a different core approach to the client – broker relationship. Particularly refreshing for me was their attention to areas of ‘uninsured covers’ where they were able to offer advice as to how these could be incorporated within our programme without incurring significant cost increases.

The wider business landscape is continually changing and as Business leaders we owe it to ourselves and our customers to continually adapt accordingly – what we hadn’t recognised was that we could use the vast resources of our broker to help us to meet this challenge.

The Gallagher team provided us with a clear plan as to how we could draw on their expertise, ranging from validation of our new COVID-19 H&S risk assessments to developing a Cyber training regime to protect us from attacks.

I can honestly say that the transition with Gallagher has been eye-opening and has added a new layer of professionalism to our approach to our business protection. Gallagher have delivered a comprehensive ‘long-term’ insurance deal when others in the market advised that it wasn’t possible. All of this has been achieved alongside substantial financial savings against the backdrop of a hardening insurance market and a global pandemic.

We entered into our original meeting with Gallagher with no great expectations but we are delighted that we have them working alongside us as we drive our business towards further growth and profitability.

The risk landscape for senior executives of a company has changed dramatically over the past decade. SME and mid-market companies and their directors and officers are exposed to a far greater range of risks than ever before.

Richard Grosvenor, Sales Director of Gallagher, specialist manufacturing insurers, explains: “Amongst SME and mid-market companies, the use of Directors’ and Officers’ (D&O) insurance is increasingly important. Decisions you make, whether as a director or an officer of a business, can resurface months or even years later in the shape of a personal claim against you, by employees, the company or a third party.

“Gallagher offers D&O liability insurance policies, providing comprehensive protection within a broad policy wording, with few exclusions and wider definitions than many other policies out there. These can be tailored.”

Typically, D&O insurance covers:

Regulatory Investigations – claims associated with regulatory investigations against individuals

Director vs. Company – allegations individual directors face from their own companies or shareholders

Criminal Actions – criminal allegations (and investigations) made against the directors and officers of a company

Defamation Cases – cases which are often bitterly pursued by the individuals or companies who feel aggrieved by comments or actions allegedly taken against them

Contract Disputes – claims which arise from disputes with suppliers and customers, following allegations of non-performance or non-payment

Corporate Insolvencies – claims made by creditors in the event of a corporate insolvency following retrospective scrutiny of company transactions, accounts, and the actions of individual directors

Harassment – allegations made against the directors and officers of a company for abusive or threatening behaviour

Privacy and Data Breaches – cases where management have accessed personal emails and messages. A growing problem due to company data being stored on personal devices, and personal data being stored on company devices

We all naturally winterise our homes: fill up the log shed or the coal hole, seal up drafty doors or windows, check the pipe lagging and get the boiler serviced. It’s no different for your business but you’d be surprised how often the office gets overlooked. Importantly, now is a good time to check your insurance policies for exclusions that might catch you out when the mercury drops.

This winter has already thrown in some curve balls: widespread and heavy flooding in Cumbria followed by snow and frost. PricewaterhouseCoopers estimates the damage from Storm Desmond at £500 million and the cost of the flooding will likely be twice that of the flood damage caused across the Lake District in 2009*. The truth is, we never really know what our weather’s going to dish out until we’re in the midst of it. But we do know that when she chooses, Mother Nature can bite hard.

Snow, ice, frost, trips and slips, burst pipes, rapid thawing and flash flooding create serious operational and liability risk issues for businesses around the country – across public services and transportation, property management, industry and general commerce. Take the St Jude’s Day storm in 2013 – over 105,000 claims and an estimated £130 million paid out to fix extreme weather damage2. While such an event is an exception rather than the rule, the colder months to March mean an extra layer of chilly risk that you need to mitigate.

In our Winter Tips bulletin, we take a practical look at the steps you can take to protect your business from the impact of bad weather this winter…

It’s snow joke: your Health & Safety responsibilities

Snow or ice on the ground means trips and slips and the potential for civil claims if you don’t follow Health and Safety at Work stipulations. Although most incidents are often minor, occasionally they can be serious.

• Keep footpaths and walkways clear of ice and snow to reduce the risk of slipping: this duty is well established both in legislation and as a result of civil claims

• The Health and Safety at Work Act emphasises that access to and from places of work be kept “safe and without such risks”.

• Workplace (Health, Safety and Welfare) Regulations specifically mentions keeping floors free from any substance that could cause a person to slip, trip or fall, “as far as is reasonably practicable”.

• The Occupiers Liability Act requires that visitors to premises are kept “reasonably safe for the purposes for which they are invited or permitted to enter”.

Regardless of these legal requirements, the issue is really one of simple good management. As an employer, you need to know where the responsibility for clearing ice and snow begins and ends and how far to go in terms of gritting and clearing. A good rule of thumb is to document the risks and respond reasonably.

• Always keep sloping footpaths safe: if it’s snowy or frosty, clear it and grit, sand or rock salt it first thing in the morning.

• Always keep emergency exits and routes clear and safe – plus keep an eye out for any danger arising from people bringing snow into your premises on their feet.

• Allocate responsibility for snow clearing/de-icing and check it is being carried out – plus explore options for outsourcing such duties to specialists who can take care of it for you.

Protecting your property – snow, drifting & freezing

Snow damage to assets and property during cold weather - or its wet aftermath - is another risk area that can hit your business. Roof areas collect snow quickly and it’s the weight, not the depth of the snow that causes damage

• Fluffy snow weighs between 5 – 20lbs per cubic foot.3

• Packed snow weighs 0– 40lbs per cubic foot.4

• Wet snow weighs 45lbs per cubic foot5 – this is the priority so clear it quickly. Tell-tale overload signs include: sticking doors on higher floors, visible cracking on wall surfaces and plaster cracks around door frames.

• Keep guttering clear and free from obstacles – you’ll need them when the thaw comes.

• Ensure all exterior and interior pipe work is lagged and protected to prevent bursts and flooding.

Take a common sense approach…

Much of winter weather risk management comes down to common sense – but whatever your business, you need to identify the potential risk areas and
address them across the Health & Safety responsibilities to your people plus the liability and business continuity risks to your business. It’s a simple check list – from pipe work, water supply, HVAC and IT to building inspection, improving your energy efficiency and handling work from home and emergency transport for your key people.

Your winter weather risk quick summary…

Snow, frost and ice

Access: pathways, entrances, exits, emergency exits, car parks, exterior steps and ramps mean trips and slips. Clear snow early in the day and use sand, salt or grit – never water.

Pipe work: check and protect exterior or interior pipes that may otherwise burst and flood in a cold snap.

Structural: keep roof areas free from standing snow or ice that may cause damage.

Fleet transportation: breakdowns, winter servicing and safe and/or winter tyres will all contribute to how mobile your fleet is – and how much it costs you - when a big chill arrives.

Car theft: in winter there’s always the temptation to leave the car running and pop back inside while it defrosts. Remember, most motor policies – personal or fleet - specifically exclude theft of vehicles (and loss of possessions) where keys are left in the car. Always stay with your vehicle when de-icing with the engine running.

Thawing and flash floods

Location: if your business is in a high-risk area then check the Environment Agency web site in England & Wales or the Scottish Environment Protection Agency (SEPA) in Scotland to check for flood warnings. You can also sign up for the floodline support service - Floodline Warnings Direct – that will alert you if you are in imminent risk of flooding. Call 0845 988 1188 for details. See below for more information. 3-5 Travelers Canada at www.thedominion.ca: The Keys to Business Risk Protection, 2013 (PDF)

Protecting your commercial assets – rapid thaw & flash flooding Storm Desmond has put flood damage high on peoples’ agendas. Check with the Environment Agency to see if your business is located in a flood-prone area. Sudden snowmelt in winter causes flash flooding just as surely as sustained heavy rain in summer.

• Plant and machinery: can you raise it above known flood water levels – or even positioned on the roof?

• Sandbags: do you have storage space for ready-prepared sandbags?

• Drainage: keep drains and gutters free of debris and other blockages with regular maintenance.

• Obstacles: keep the roof or any terrace areas free of all vegetation that could damage the roof and let in heavy rain or snowmelt.

• Scoping: commission a Flood Assessment Survey to set your baseline knowledge of the risks

• History: if your business – or the properties you manage - lie in a high-risk area, check public records to help set your flood expectations.

The practical flood protection measures you can take right now.

Understanding the topography of flood risk management is one thing, but what are the practical steps you can take straight away?

Here we outline the physical actions that can help cut your risk exposure.

• Plant and machinery: can you raise it above known flood water levels – or even positioned on a roof?

• Early warning: if your business is in a high-risk area then check the Environment Agency web site in England & Wales or the Scottish
Environment Protection Agency (SEPA) in Scotland to check for flood warnings

• Sandbags: do you have storage space for ready-prepared sandbags?

• Drainage: keep drains and gutters free of debris and other blockages with regular maintenance

• Obstacles: keep the roof or any terrace areas free of all vegetation that could damage the roof and let in rain or snowmelt

• Scoping: commission a Flood Assessment Survey to set your baseline knowledge of the risks

• History: if you’re based in a high-risk area, check public records to help set your flood expectations. Check the flood history of your
premises.

• Water supply: check the plumbing of all equipment or infrastructure use a water supply – from washrooms to vending machines.

• Sprinkler systems: minimise the risk of leakage with regular, thorough and manufacturer-approved maintenance processes.

Protecting your business continuity

We’ve seen it before – traffic networks paralysed and roads blocked when the white stuff falls. Your people can’t get into work or out to customers,
deliveries are interrupted and business suffers. With a bit of pre-planning, you can avoid the risks to the continuity of your business:

• Use mobile comms and the web to keep your business operating: can’t meet face-to-face? Explore videoconferencing. Ubiquitous broadband, personal smartphones, tablets and free web services like Skype, Viber or FaceTime will help keep you and your people in touch at minimal cost

• Identify your business-critical activities: ‘business as usual’ may not be possible so be ready to concentrate on those ‘must do’ processes and ‘must-have’ people

• Car sharing: it sounds simple but work out who can ‘buddy-up’; you’ll have more people in, more of the time. Find out who drives a 4x4 and use as many as possible for car sharing. Alternatively lay on minibus transport if practicable.

• Work from home: it’s back to the technology. When everything grinds to a halt, ensure you know who can work from home and let them get on with it

• Work with your suppliers: if your supply chain is under threat, plan in advance. Discuss alternative options with your suppliers and/or customers so you can switch quickly and easily to Plan B.

Sources:

* PricewaterhouseCoopers – ‘Storm Desmond damage across Cumbria estimated at £500m’ by Jill Treanor, Julia Kollewe and Sean Farrell, The Guardian, 8th December 201

** Association of British Insurers (ABI) Press Office – news release at www.abi.org.uk, 5th November 2013

This bulletin is not intended to give legal or financial advice, and, accordingly, it should not be relied upon.
Have you changed your business recently? Common Insurance Pitfalls for Manufacturers

Insurance is something we all know is important. It can also be something that we overlook. Many manufacturing businesses have fallen foul during insurance claims due to not having correct insurance in place. Steve West, Development Executive at Gallagher, leading insurance broker and risk managers, held a Masterclass with Made in Group to educate manufacturers on what the common insurance pitfalls are for manufacturers.

Made in the Midlands patron Gallagher held an insightful masterclass packed full of information industry leaders need to know. Highlights from the 15 minute presentation included an overview of the insurance market, the meaning of underinsurance and what can lead to underinsurance.

As a result of the pandemic coupled with Brexit and other political changes, many manufacturers have increased their capability and undergone changes. This could mean that their current insurance doesn’t cover them.

Here are some of the common insurance pitfalls for manufacturing businesses and how to avoid them:

Property - Up to date evaluations are critical. If not annually, this should be done every two years. This applies to changes in the businesses, ensure this is declared so you can make sure you aren't underinsured. Finally, many businesses make the mistake of only insuring the property to the market value, rather than taking into consideration the cost of construction and clearing debris. Ensure to do this on a reinstatement basis.

Stock & Contents - If you have an old machine that is critical to be replaced, you need to consider the cost of the modern day equivalent. In addition to this, many manufacturing businesses have increased stock holdings due to supply chain issues, this must be declared to your insurance broker.

Storm water is heavy: each cubic foot weighs around 63lbs and its fast, running at anything between six and 12 miles per hour. In full spate, it is relentlessly destructive and unpredictable. At rest, it is often an unpleasant pollutant that’s expensive to clean up.

The figures speak for themselves; average UK insured losses were £343 million in 2011 and average annual flood damage across the UK currently runs at around £1.1 billion - bigger than the yearly budget of the Environment Agency. Risk is escalating with current estimates indicating a potential rise to annual damage totals of £27 billion a year by 2080. Today, around 300,000 business premises are at risk of flooding in England alone. To cap it off, friction remains between insurers and government regarding the maintenance of flood defences. While it’s up to the politicians to manage how best to deal with the problem, it’s down to you to manage an immediate risk that at best will hamper your business and at worst, stop it in its tracks.

As Made in the Midlands Patron’s, Arthur J. Gallagher has some sound advice on how to perform pre-event risk analysis and how to take preventative actions to reduce the impact on your business should the worst happen. The right insurance policies from a broker expert in water risk management can make all the difference.

The Business Continuity Institute recently released their 10th annual Supply Chain Resilience Survey, which highlighted the key causes of business interruption. The report, in which 589 professionals highlighted the top 5 causes of disruption to their business, identified cyber-attacks and data breaches as the leading challenges for industry professionals despite an increased trend for utilising business continuity plans as part of their day-to-day operations.

The Institute also found that IT outages and weather conditions were high on respondents concerns, as were employee health issues and health and safety compliance. Businesses were also worried about loss of their key talent while another common concern related to transport network disruption.

Supply chain disruptions have increased from 70% to 73% since last year, though the number of organisations affected has decreased from 65% down to 56%. 52% of the organisations surveyed reported a disruption from a Tier 1 supplier, though worryingly an increased number of respondents confessed to failing to analyse the cause of disruption.

The risk landscape for supply chains has changed since 2017. While unplanned IT and communications outages (53%) remain the top cause of disruption, adverse weather (41%) is next in line, rising from sixth place in 2017, with cyber attacks and data breaches (33%), loss of talent/skills (30%), and transport network disruption (27%).

While you cannot predict or prevent a supply chain disruption, there are ways to anticipate and better prepare your business for the event. We can help support your manufacturing business through a dual approach of risk management consulting teamed with a comprehensive insurance offering. We will work with you to identify the types of supply chain risk that your business is likely to come up against and to build a contingency plan to help you get your business up and running as quickly as possible following a supply chain disruption. We offer a number of insurances including cyber, crisis resilience, business interruption and terrorism.

To find out more about how we can help your business weather a supply chain disruption, please get in touch by calling [number] or emailing [email].

The BCI’s survey was conducted online with 589 respondents from 76 countries.

Over 60 businesses from across the Midlands attended an interactive business seminar on corporate manslaughter at Tollerton
Hall in Nottingham this week, offering directors and owners of local companies a detailed insight into what happens when a company has to answer to the Health & Safety Executive (HSE) in the wake of a death or serious injury in the workplace.

The interactive event was organised by Midlands insurance broker, Arthur J. Gallagher, and presented by a team of in-house risk management experts, in partnership with legal advisors from national law firm, Mills & Reeve.

During the three-hour seminar, attendees were able to experience first-hand a director of a fictional company face questioning under Police and Criminal Evidence (PACE) conditions following a corporate manslaughter charge.

Withaudience participation throughout, as well as open Q&A at the end, the event was crafted to raise awareness of having comprehensive health and safety policies and procedures in place, as well as ensuring the correct level of liability insurance protection.

Tracy Keep, Account Director at Arthur J. Gallagher said: “Since the introduction of the Corporate Manslaughter and Corporate Homicide Act 2007, almost every prosecution for corporate manslaughter has been against owner-managed businesses. While it’s easy to dismiss the media headlines and think this could never happen to your company, the reality is that the number of these kinds of case is on the rise and SMEs are at the biggest risk.

“Businesses can be found guilty of corporate manslaughter as a result of gross breach of duty of care arising from serious management failure – and the legal costs of defending a corporate manslaughter charge can quickly mount up.

“Prevention is always better than a cure so the aim of this week’s seminar was to create a format for our clients to understand that an incident and subsequent prosecution can happen to any company of any size – and that getting the right policies, procedures and protection in place is more important than ever before.

“The event was a real eye-opener for those attending. We were delighted with the turnout and feedback after the event was fantastic.”

Ian Mayers, Partner at legal experts Mills & Reeve also points out that new sentencing guidelines were proposed back in 2014 and — after consultation — these new guidelines are due to be published very shortly with the view to them coming into force in 2016:

“Whilst it is anticipated that the overall effect of these new guidelines will be to further increase the average fines imposed for convictions, especially on larger businesses, under the Corporate Manslaughter and Corporate Homicide Act 2007,” he explained, “it is likely that practical issues, such as the requirement on organisations to co-operate more fully with regulators, even post-conviction, will be just as significant.”

Ian continues: “But, don’t forget, in addition to any headline financial penalty imposed by the courts, organisations need also to consider the other possible negative effects of a conviction which include massive business interruption, reputational damage, substantial prosecution costs and the victim impact surcharge imposed by courts.”

Arthur J. Gallagher’s top five tips for protecting your business against a corporate manslaughter charge:

1. Know your risks - carry out regular risk assessments for employees and all other service users. Preventative measures, as well as strategies for coping when risk situations arise, are essential in ensuring both employees and the company are protected.

2. Health and safety first - review your health and safety procedures and address any shortcomings, with strict monitoring of implementation to ensure things are not forgotten.

3. People training - well documented training, at all levels, is essential in ensuring all staff are competent in their understanding and responsibilities around health and safety.

4. Lloyds are a charity partner of Mental Health UK, however Gallagher also believe it is an important cause, especially after a turbulant 18 months. Richard said:

"I’m doing the walk because I wanted to raise awareness on the issues people have faced during the pandemic in regards to mental health. It’s been a challenging 18months for many people and the after effects of Covid-19 will go on for many years I truly believe. I have close friends which have suffered mentally because of the isolation the pandemic created and if I can personaly do anything to support the charity I want to try."

UNDERINSURANCE CAN HAVE POTENTIALLY SERIOUS CONSEQUENCES FOR YOUR MANUFACTURING BUSINESS

In the last survey conducted by the Chartered Institute of Loss Adjusters, 40% of Business Interruption (BI) policies had inadequate sums insured declared when calculating premiums resulting in an average underinsured shortfall at of 45%(1).

What types of cover could be most at risk of underinsurance? Here are some of the most common reasons for underinsurance.

Buildings cover: Buildings should be insured for reinstatement cost. This can include costs such as labour, site clearance and professional fees. If in doubt a professional valuation by a RICS qualified valuer is an option.

Underestimating the value: Claimants often assume the current or second hand value will sufłce in the event of a loss. Yet many insurers may look to replace as new.

Business interruption: It can be easy to underestimate how long it’ll take for your business to get up and running again after an insured event. A common outcome is for the period of cover to be far shorter than the actual period of disruption leaving the business owner with ongoing losses after the insurer stops paying. To work properly, your policy requires a thorough Commercial Feature and up-to-date assessment of the interruption exposure.

Inflation: You should also remember to factor in inŃation over a period of time. Insuring for an outdated purchase price can prevent replacement for that same cost. It is important to consider midterm fluctuations in material costs through inflation or market forces. Certain types of goods are more subject to market forces than others with some having the potential to increase in value signiłcantly in a short space of time.

Regular reviews: Failing to review historical sums insured at policy anniversary can lead to large gaps. Acquiring new plant and machinery, adding a new computer system, or increasing stock volumes are not always quickly linked by customers to the need for an insurance conversation. It is best practice to undertake this annually but you should dełnitely not let longer than three years go by between updates.

If you would like to discuss your current cover limits simply contact Steve Fletcher on 0121 222 0721 or stevefletcher@ajg.com. (

Insurance broker, and the title partner of Premiership Rugby, Gallagher, has launched a UK-wide initiative - ‘Tackling Tomorrow. Together’ – bringing to life stories of six UK businesses and a charity that have shown resilience, tenacity and pioneering spirit during the COVID-19 pandemic.

To highlight the diversity of challenges and opportunities presented by the pandemic, Made in the Midlands, a manufacturing & engineering peer-to-peer membership association, has been selected to participate in the programme in recognition of their efforts and resilience during the COVID-19 pandemic.

Made in the Midlands – part of the ‘Made In’ group, a network which supports and champions over 600 manufacturers in the UK – will be paired with Gallagher Premiership clubs Wasps and Worcester Warriors as part of the 'Tackling Tomorrow. Together' initiative. During the pandemic, instead of their yearly exhibition, Made in the Midlands built a virtual display to replace the cancelled physical event. The association’s popular breakfast events also went virtual, with lucky members receiving a hamper of local treats to enjoy at home. Going virtual increased participation at these events by 500%, hugely benefitting members during a time of impacted training.

Gallagher helped to support Made in the Midlands during this time with free online ‘Cyber Security’ webinars for members to highlight not only the tools cybercriminals use to infiltrate IT systems, but the increased vulnerability firms are experiencing due to greater reliance on online activity and remote connectivity during the pandemic.

Each organisation will be partnered with their local Gallagher Premiership Rugby club and given opportunities to promote their business within their local communities with the aim of getting in front of new audiences and potential customers. This includes in-stadia advertising such as big screen promotions and programme adverts, region-specific digital marketing and tickets to host a business networking event when spectators are allowed back into Premiership stadia. Each organisation will also receive a ‘meet and greet’ session for employees with their local Gallagher Premiership Rugby players. This will all be delivered through Gallagher’s position as title partner of Premiership Rugby. In addition to the rugby-related package, Gallagher will continue to offer specialist broking advice and support to each organisation.

Michael Rea, Chief Executive of Gallagher’s UK Retail Division, commented:

“As a local insurance broker, Gallagher is working around the clock with UK businesses – large and small – to help them navigate the challenges and evolving risks that have arisen from the tough trading conditions of the past 12 months.

Businesses have been left grappling with lockdowns, changes to their insurance requirements, and understanding new risk exposures, with many being forced to quickly adapt their offering or diversify their business model in response to the pandemic and lockdown restrictions.

It has been incredible to see the optimism and tenacity of some of these businesses and we wanted to take a moment to champion and recognise both the challenges and opportunities presented during an extraordinary period through our ‘Tackling Tomorrow. Together’ initiative.”

Six businesses and one charity will be partnered with Premiership Rugby clubs to promote their businesses over the next twelve months.

Dunes (Newcastle Falcons)

Jason Pitt, Director, Made in the Midlands, said: "During a crisis, the first thing you need to do is accept where you are. As a business, we moved quickly to innovate and invest. It's far more productive to invest time in solving a problem than to be paralysed with fear. Gallagher has stood alongside us as a business as we have moved into the virtual space, offering their online ‘Cyber Security’ webinars for all our members. Like us, they have found progressive ways to help us as a business, rather than simply standing still."

Made in Group is dedicated to sharing best practice knowledge with manufacturers and relevant businesses in the Midlands and Yorkshire community. In this masterclass, exclusively for Made members Gallgaher’s Steve West walks us through:

What is Underinsurance?

Essentially this is when a policy holder has inadequate insurance cover for their needs. Here Steve goes into detail about:

What would happen if there was to be a loss within a manufacturing firm

The common areas of underinsurance for manufacturers

The impact of underinsurance

What can lead to being underinsured?

Can you ensure your valuations are up to date?

Are you aware of your standard policy limits

Not declaring the correct sum that needs to be uinsured

The Common Pitfalls

Property

Stock & Contents

Plant & Machinery

Business Interruption

For more on how to ‘Prevent Pitfalls’ when it comes to underinsurance, watch the full masterclass here.

PROTECTING YOUR BUSINESS FROM CYBER CRIME

The risks and impacts of
cyber attacks and financial fraud are becoming an increasing headache in
Britain’s boardrooms. Steve Fletcher, Manufacturing Specialist at UK insurance broker
Arthur J. Gallagher explains how a cyber insurance
policy can best protect your workplace from online fraudsters.

Cyber and
financial crime is on the rise, with fraudsters targeting businesses anytime,
anywhere – with many unprotected. The Cyber Security Breaches Survey 2016* revealed
that 65% of large firms detected a cyber security breach in the past year, with
the average cost of an attack amounting to £36,500.

A tailored
cyber insurance policy can protect your firm against the multiple impacts of a
cyber attack, as well as manage the investigation process. From identifying the
breach and neutralising the threat, to providing your business with legal and
PR advice, while covering the costs to notify those affected, as well as any
fines, the benefits could be priceless:

Your reputation is
strength

Compromised
systems can result in a loss of loyal customers and a damaged reputation. Cyber
liability insurance ensures the costs are covered in engaging the help of a
dedicated public relations firm as well as the loss of future sales that arise
as a direct result of loss of custom.

Data is your most
important asset

Data is not
covered by most standard property insurance policies. A cyber policy with
comprehensive cover will include data restoration, no matter how the loss
occurred.

You can be held liable
for any third party data that is lost

Cyber
liability insurance ensures protection against non-disclosure agreements and
contracts that contain indemnities and warranties in relation to this type of breach,
as well as consumers seeking legal redress in the event of loss of data.

Operating systems are
critical

All companies
rely on operating systems to manage their business, but in the event of your
business suffering unplanned downtime as a result of a computer virus, hacking
incident or even malicious employee attack, a traditional business interruption
policy may not respond. Cyber insurance provides you with cover for loss of
profits associated with a systems outage caused by such attacks.

Portable devices
increase the risk of loss or theft

Cyber
insurance can help to cover the costs associated with breaches of data should a
portable device, such as a laptop, become lost, stolen or the victim of a
virus.

Social media claims are
on the rise

Information
shared online can give rise to liability for businesses that are responsible
for the conduct of employees on social media sites. Should claims arise as a
result of leaked information, copyright infringements or defamatory statements,
cyber insurance can help to cover associated costs.

Whilst
strengthened security procedures, good digital housekeeping and high user
awareness will reduce the likelihood of your business suffering from an attack,
it does not guarantee that you will not be hit, or mitigate the damaging
effects of a breach. This makes cyber liability insurance a must have to
protect against the potentially crippling financial effects of a security
breach.

In this article, we are looking at the part of the presentation which detailed what is trade credit insurance and who buys trade credit insurance.

Through this event , Gallagher wanted to take the manufacturing leaders within Made in Group through what you can do to mitigate the threat of delayed and unpaid invoices.

A longstanding patron of Made in the Midlands, Gallagher and are a global business insurance, risk management and consulting services company; with Gallagher in the UK being specialists in manufacturing companies.

In a strategic move to reinforce support for the thriving manufacturing community in the Midlands, Gallagher Insurance Brokers have announced an exciting development—a dedicated point of contact for members of Made in the Midlands. This initiative aims to enhance engagement and provide specialised assistance to manufacturing businesses in the region, solidifying a long-term partnership between Gallagher and Made in the Midlands.

Steve West, the newly appointed head of engagement at Gallagher, shared insights into his role and the significance of manufacturing for the insurance sector. Having joined Gallagher two years ago, Steve was promoted to the position of Sales Lead for Birmingham in December, overseeing a team focused on new business growth within the Birmingham area.

Gallagher works with more than 4,200 manufacturing and heavy engineering businesses throughout the UK. Steve emphasised the company's commitment to being more than just a broker; they strive to be an extension of their clients' businesses, providing face-to-face services and understanding the unique challenges faced by manufacturers.

Members can meet Steve and Gallagher at various events throughout the year, and he will also be on hand at the Manufacturing Growth Strategies event on the 3rd April 2024, which will be taking place at Crowe UK LLP in Oldbury.

The partnership aligns seamlessly with Made in the Midlands' mission to champion British industry. Gallagher's dedication to supporting local businesses and their involvement with Made in the Midlands reflects a shared commitment to fostering growth within the manufacturing sector.

Steve West brings two decades of insurance expertise to his role, primarily in new business development. His background in understanding the intricacies of corporate entities, particularly in the manufacturing sector, positions him as a valuable asset in Gallagher's pursuit of engaging with larger global businesses.

While insurance may be perceived as a commodity, Gallagher distinguishes itself by offering comprehensive risk management services beyond insurance products. From Health and Safety support to Cyber Risk Management, Trade Credit and assistance with mergers and acquisitions, Gallagher serves as a consultant, addressing a spectrum of business needs.

The ever-evolving economic landscape presents new challenges, such as trade risks and supply chain disruption. Gallagher's approach involves a thorough understanding of each client's business, allowing them to tailor solutions to mitigate specific risks effectively.

Underinsurance emerges as a common risk factor for manufacturing companies. Gallagher collaborates with valuation services to ensure clients are adequately covered, actively working to prevent underinsurance issues in buildings, machinery, and other assets.

Clients who have worked with Steve West and Gallagher describe the partnership as an extension of their business rather than a transactional relationship. Regular communication, webinars, and topical seminars contribute to the visibility and accessibility that Gallagher maintains throughout the year.

Despite Gallagher’s global stature, the company maintains a community-focused approach, staying deeply connected with clients on the ground.

Looking ahead to 2024, Steve envisions Gallagher as the go-to insurance broker for the manufacturing sector, continuing to drive growth and support clients' evolving needs. As the manufacturing sector faces uncertainties, Gallagher remains a dedicated partner, providing innovative solutions and committed support to ensure businesses can navigate challenges with confidence.

In conclusion, the partnership between Gallagher Insurance and Made in the Midlands signifies a commitment to the growth and success of the manufacturing community in the Midlands. With Steve at the forefront, Gallagher is poised to deepen its engagement and provide tailored solutions, reinforcing its position as a trusted partner for manufacturing businesses in the region.

The EU Referendum is almost upon us. With the public debate awash with claim and counter-claim, Steve Fletcher, Manufacturing Lead at Arthur J. Gallagher cuts through to what he knows about: your business insurances and what might happen to them in the event of the UK voting LEAVE on June 23.

Separation from the EU and Article 50 of the Lisbon Treaty …

Once triggered by the UK Government, Article 50 provides for a two-year exit negotiation period that would re-define our future relationship with the EU.

In that 24 month period, everything would stay the same as it is today with the UK bound by existing EU legislation – unless an agreement was reached earlier.

As the Article 50 negotiations move forward the two-year period could be extended by mutual consent.

When negotiations are concluded that’s still not it. The exit deal must then be concluded on behalf of the EU by the EU Council (Consilium) – the political leaders of all EU member states – by a qualified majority after obtaining the consent of the European Parliament.

Any exit process is complex and unpredictable; the UK would not have a vote on the withdrawal agreement.

A potential BREXIT vote would mean no change - business as usual – to our legislative relationship with the EU until 2018 at least. It would also mean absolutely no change to how – and where – your business insurances operate until formal exit ratification. However there are two changes to UK insurance on the way: The Insurance Act becomes law on 12th August 2016 and insurance premium tax increases to 10% from 1st October 2016.

Should BREXIT become a political reality with all hurdles cleared come 2018/19, there are operational areas of your business insurances that may change, such as:

• Effects on UK-issued insurance policies covering subsidiaries in the EU.

• International freight industry agreements.

• Reciprocal arrangements around the treatment of certain insurable incidents.

• Repeal of unspecified EU Directive legislation.

• Product recall and the Rapid Alert System (RAPEX) for non-food dangerous products.

• Selected consumer protections.

• Withdrawal from EU Supreme Court judgements on areas like product liability, product safety and riskmanagement.

• Likely loss of mutual recognition/passporting for UK financial institutions.

• Likely changes to - and/or uncertainty around - legal and regulatory frameworks: important if you

trade with EU states.

The long term insurance ramifications of a BREXIT vote are impossible to map. What we can say with someconfidence is that Article 50 of the Lisbon Treaty provides for a two-year period where there will be NOinsurance changes for your business other than those already planned through domestic legislation. As yourinsurance broker we’re here to help you plan ahead we’re already assessing the longer-term contingenciesthat firms of all types should consider.

Would you like to talk?

If you want a confidential discussion about your business’s manufacturing risk management and insurance

services please contact Steve Fletcher on Tel: +44 (0) 121 222 0721 or email Steve Steve_Fletcher@ajg.com

IMPORTANT INFORMATION:

While we have attempted to ensure that the information contained in this guidance note has been obtained from reliable sources or is otherwise accurate, we

are not responsible for any errors or omissions or inaccuracies.
The importance of British based manufacturing may be vital to the revival of the UK economy Gallagher is committed to the part we can play in that process. Recent events in the UK have perfectly illustrated the importance of ‘outside the box’ commercial thinking.

There are many varied challenges that face British manufacturers in ‘normal’ times but, during a pandemic, you quickly come to realise which parts of your supply chain have stood up to the test and been there when you needed them most.

At Gallagher, we are proud to have received several testimonials thanking us for the way in which we have supported our customers to respond to these unpredicted financial traumas. We have achieved this through a range of mechanisms; making premium cost savings at a vital time when savings are needed to be made against a backdrop of COVID-19 and a hardening insurer market, offering advice on furlough and how it impacts commercial insurance programmes, providing COVID-19 ‘back to work’ risk assessment validations, obtaining credit insurance cover to help safeguard the debt book of anxious businesses, agreeing to interest-free terms with insurers and a cross-section of other practical and meaningful initiatives.

Our door is wide open to other Made in Group manufacturers and we will be pleased to talk to you either directly or via the new EXPO mechanisms.
